Electoral court voids Garotinho’s votes, and Douglas Ruas is set to be Rio governor with no runoff. Paes appeals to the Supreme Court
The court formed a majority to deny Anthony Garotinho’s registration and declare the votes cast for him void. With the re-tabulation, Ruas (PL) moves past 50% of valid votes; at 37, he will be the state’s youngest governor since 1959.
The Superior Electoral Court (TSE) formed a majority on Thursday to deny Anthony Garotinho’s candidacy registration for governor of Rio and declare void the votes he received on Sunday, October 4. The rapporteur voted to reject the request to withdraw the appeal and to judge the case on the merits, and was joined by the majority, according to G1. In the count released by the press, Douglas Ruas (PL) had 49.27% of valid votes, Eduardo Paes (PSD) 42.76% and Garotinho 3.17%, about 274,000 votes. Without them in the calculation, Ruas goes past half of the valid votes and wins in the first round. Garotinho’s candidacy had already been blocked by the TRE-RJ, the state electoral court, and his votes were counted as sub judice; in an analysis, Valor wrote that the voiding surprised no one. With the decision, Rio drops off the list of states with a gubernatorial runoff, and Rio voters return to the polls on October 25 only to choose the president, unless the Supreme Federal Court (STF) changes the result. Ruas said he “trusts the courts” and is waiting for the re-tabulation of the votes to be declared elected, Valor reports. A civil police officer and congressman, he is 37 and will be Rio’s youngest governor since 1959, according to O Globo. His running mate is expected to be Fernanda Louback, a friend of Michelle Bolsonaro.
The case had a behind-the-scenes chapter. The day before, G1 and Estadão revealed that Garotinho’s lawyer appears in the TSE system as the author of a document used in the opinion from the Office of the Electoral Prosecutor-General (PGE) favoring the withdrawal. The PGE blamed a technical glitch and said the filing was prepared by members of the Public Prosecutor’s Office; Estadão also reported that the prosecutor in charge once taught classes alongside the former governor’s lawyer. Paes, who called the withdrawal a “maneuver,” announced that he will go to the STF against the decision and ask for a runoff to be held, according to G1 and Valor. According to O Globo, after five former governors were jailed, Rio will have a governor under investigation before even his swearing-in. On the same day, the TSE postponed the ruling on the validity of the candidacy of Deltan Dallagnol, elected senator for Paraná. Justice Kassio Nunes Marques said the decision on all the states that will have a runoff should come on Thursday.
